Former Municipal Manager Abbey Dlavane Sentenced To 5 Years In Prison

The former municipal manager of the Dr Kenneth Kaunda District Municipality, Advocate Abbey Dlavane (61), has been sentenced to five years of direct imprisonment for theft and violating the Municipal Finance Management Act (MFMA).

The sentencing took place at the Klerksdorp Magistrates’ Court this week, marking a significant move in the fight against corruption in local government.

Dlavane Convicted For Fraud Involving R550,000

Dlavane’s conviction follows financial misconduct committed during his tenure between January 2009 and March 2020.

According to court proceedings, he instructed the municipality’s credit controller to issue a cheque worth R550,000 to Kumekucha Investment, a company he solely owned.

The payment was made for services that were never rendered, amounting to theft of public funds.

The court found that Dlavane’s actions breached ethical standards and directly contravened Section 173 of the MFMA, which governs the responsible management of public resources.

Suspended Sentence

While Dlavane received five years of direct imprisonment for the theft charge, he was also sentenced to three years for violating the MFMA.

However, the three-year sentence was wholly suspended for five years, contingent upon him not committing a similar offence during that period.
