The ruling was delivered on Thursday, 22 October 2026, following a virtual hearing the previous day. The couple face allegations of theft, fraud and money laundering involving approximately R11 million allegedly taken from 15 deceased estates.

Peter Nonyane And Charlotte Tibana Lose Bail Appeal

The R11 million deceased estates case centres on allegations that funds belonging to deceased individuals were unlawfully withdrawn and laundered.

The State alleges that Tibana, who was appointed executor of the estates, withdrew money from the accounts before it was transferred through various other accounts. Prosecutors claim the transactions were intended to conceal the source, movement, location and ownership of the funds.

The Peter Nonyane and Charlotte Tibana case includes allegations about how some of the money was spent.

According to the State, approximately R1.65 million of the alleged proceeds was used to purchase a pre-owned Mercedes-Benz AMG G63 from a dealership in Pretoria. Nonyane is also accused of using some of the money for stokvel contributions and the construction of a residential property.

Two Co-Accused Granted Bail In Deceased Estates Case

Two other accused in the broader deceased estates theft case, Rirzhaku Tibana and businessman Jabulani Nephtal Maluleke, were granted bail of R60,000 each by the Polokwane Magistrate’s Court on 8 October.

Rirzhaku Tibana is Charlotte Tibana’s younger sister. The State did not oppose their release, according to Malabi.

The two accused collectively face 101 charges, including fraud, theft and money laundering, arising from allegations linked to the administration of the 15 estates. As part of her bail conditions, Rirzhaku Tibana must report to Letsitele Police Station every Friday between 8am and 4pm. Maluleke must report to Pretoria Police Station during the same hours.

The matter has been postponed to 6 November 2026 for further investigations. Nonyane and Charlotte Tibana remain in custody following the High Court’s dismissal of their bail appeal.
