Mother Who Killed Alleged Rapist Of Daughter With Disability May Have Charges Dropped

A 44-year-old woman from Lady Frere in the Eastern Cape, accused of killing a 65-year-old man who allegedly raped her daughter with disability, may have her murder charge withdrawn if it’s proven she acted in defense of her child.

The National Prosecuting Authority (NPA) has confirmed that the case has been referred to the Director of Public Prosecutions (DPP) for further investigation.

Public Support For The Accused Grows

Eastern Cape Social Development MEC Bukiwe Fanta is leading the call for charges to be dropped, describing the woman’s actions as a “desperate attempt to protect her child from a violent predator.”

Fanta’s office has announced plans to write a formal letter to the NPA requesting the case be reviewed with compassion and understanding.

According to Fanta, the case must be seen in the broader context of South Africa’s alarming rate of gender-based violence, emphasizing that parents in similar situations would likely act similarly.

A similar case in 2017, known as the “Lion Mama” case, saw the NPA withdraw murder and attempted murder charges against a mother who killed one of three men raping her daughter and injured the other two.

The mother had claimed she phoned the police station, but the call went unanswered, prompting her to rush to her daughter’s aid.

NPA spokesperson Luxolo Tyali noted that if it’s proven the mother acted to defend her daughter, they will consider it a case of defense.

According to Tyali, the legal system should protect the vulnerable rather than punish those acting in defense of loved ones.
