Legal Expert Explains Dependent Rights In Mabuza’s R44 Million Pension Dispute

The legal dispute surrounding the late Deputy President David Mabuza’s R44 million pension has escalated.
One of Mabuza’s children has approached the court urgently, seeking to halt the pension distribution until her rights as a beneficiary are confirmed. She is also challenging the validity of the marriage certificate produced by Mabuza’s wife, adding complexity to the case.
Understanding Dependent Rights Under the Pension Funds Act
Speaking to Sizwe Dhlomo on Thursday, Kholofelo Mashitisho, Managing Director at Mashitisho Attorneys, explained the daughter’s legal standing.
“Section 37C of the Pension Funds Act says that the trustees of a fund, in this case Alexander Forbes, have the discretion to decide how the benefit is allocated,” Mashitisho said.
She added that the fund cannot release the full payout to Mabuza’s wife until it is verified whether other dependents exist. This legal safeguard ensures that dependents have an opportunity to claim their rightful share.

The outcome of this case could set a precedent for how large pension payouts are handled when multiple potential beneficiaries are involved.

Mashitisho emphasized, “The trustees must carefully consider all dependents before making any distribution, to avoid legal repercussions and ensure the law is upheld.”
