Cultural Expert Calls For Clearer Framework For Traditional Leadership After Zulu Throne Court Ruling

The Supreme Court of Appeal (SCA) has officially brought closure to the long-running dispute over the Zulu throne. On Monday, the court in Bloemfontein ruled that President Cyril Ramaphosa acted lawfully when he recognised Misuzulu kaZwelithini as the Zulu King in 2022.
The ruling overturns a 2023 decision by the Pretoria High Court, which had previously sided with Princes Mbonisi and Simakade Zulu — both challengers to King Misuzulu’s ascension.
The SCA found that due process had been followed, clarifying that while the president confirms the appointment, it is the royal family that holds the authority to select the monarch.
Oral Traditions Leave Room for Disputes, Says Expert
Cultural expert Professor Musa Xulu believes that although the ruling settles the immediate question of leadership, it highlights broader governance challenges within traditional systems.
“The Traditional and Khoi-San Leadership Act, No. 3 of 2019, was introduced to address how leaders are appointed,” Xulu explains. “Basically, it should be based on your traditions. It is very much based on oral and customary perceptions… the Act does not prescribe how it must be.”
He argues that because much of traditional leadership operates through oral customs, the absence of written guidelines often leads to confusion and disputes among royal families.

Professor Xulu has previously suggested a more formalised approach to preserve and protect traditional governance systems.
“I once mentioned to the president in passing that he should consider forming a committee that would be able to help write down codification for all these customary practices,” he says.
When asked about the likelihood of another legal challenge following the SCA’s decision, Xulu says it’s improbable but not impossible. “That judgment is very tight, but you never know,” he adds.
