Top Municipal Officials Found Guilty Of Theft And Financial Misconduct

The Kimberley Commercial Crimes Court has delivered a significant verdict on 16 July 2024, finding two former senior officials of the Karoo Hoogland Municipality guilty of theft and contraventions of the Municipal Finance Management Act.
This verdict marks the culmination of a lengthy trial that has garnered substantial public interest.
The former municipal manager, Louis Nothnagel (62), and the deceased former chief financial officer were found guilty of paying each other performance bonuses without the necessary approvals.
These actions were in direct contravention of the Municipal Finance Management Act. The illegal payouts highlighted severe lapses in financial governance within the municipality.
Arina Botha (52), the wife of the deceased CFO, faced charges of money laundering related to the same financial misconduct.
She was found guilty in connection to the illicit financial activities overseen by her husband and Nothnagel. This aspect of the case underscores the broader implications of financial malfeasance extending beyond official roles.
Jacobus van Schalkwyk (62), the deputy CFO, had charges against him withdrawn after being found not guilty on all counts. This decision reflects the court’s careful consideration of individual accountability in the complex web of municipal financial operations.
The matter has been postponed to Tuesday, 01 October 2024, for sentencing proceedings. The upcoming sentencing will be closely observed, as it will likely set a precedent for handling similar cases of financial misconduct within public institutions.
