Former deputy national police commissioner Shadrack Sibiya has been denied bail by the Randburg Magistrate’s Court after three weeks of arguments between the State and his defence.

The 59-year-old faces charges including the alleged rape of an 18-year-old woman, sexual grooming of a 16-year-old girl and human trafficking. He has denied the allegations against him.

Shadrack Sibiya Denied Bail After Three Weeks Of Arguments

The Shadrack Sibiya bail application followed his arrest last month at a Sandton strip club.

The State opposed his release, arguing that granting bail would be unjust given the seriousness of the charges and concerns raised during the proceedings. Prosecutors also presented arguments opposing his release while the case continues.

During the bail hearing, the court heard evidence about WhatsApp exchanges between Sibiya and the 16-year-old girl he is accused of sexually grooming.

Investigating officer Detective Sergeant Nokukhanya Ndlovu testified that the messages were explicit and that Sibiya allegedly made several calls asking the teenager to send sexually explicit pictures and videos of herself. Sibiya has denied sexually grooming the girl.

Sibiya Faces Rape And Human Trafficking Charges

The Sibiya case also involves allegations that he raped an 18-year-old woman. Sibiya confirmed having sexual intercourse with her but maintained that it was consensual. The State disputes his account and has argued that its evidence supports the charges against him.

The court also heard an affidavit from Sibiya’s son, Ofentse Magwenya, read by his lawyer, Estelle Killian. The affidavit stated that Bishop Azwihangwi Maumela had acted independently when he contacted one of the complainants in the case. The evidence formed part of the material considered during the bail proceedings.

The Shadrack Sibiya bail ruling means the former senior police officer will remain in custody while the criminal case proceeds. The decision concerns his release pending trial and does not amount to a determination of guilt on the charges he faces. Sibiya has since resigned from the South African Police Service following disciplinary proceedings.
