KZN Mayor Convicted Of Fraudulent Use Of Municipal Funds For Lavish Funeral

A former mayor, Nomagugu Luzulane, is set to be sentenced next month after being found guilty of fraudulently using municipal funds for a luxurious funeral.

Luzulane, who was the mayor of the rural Ingwe Municipality near Pietermaritzburg, misappropriated funds that were meant for food parcels for the poor to treat mourners at her boyfriend’s brother’s funeral.

The fraudulent activity came to light during Luzulane’s trial at the Durban Specialised Commercial Crimes Court. It was revealed that she had ordered the municipality to pay for catering, sound, and a tent for the funeral in April 2012.

Despite awareness among municipal officials, including the then municipal manager, that the funds were being misused, they chose to turn a blind eye.

In July, magistrate Garth Davis convicted Luzulane on charges of fraud and breaching the Municipal Finance Management Act. Throughout the trial, she maintained her innocence, denying any romantic involvement with Amos Zondi, who was a councillor at the time, and alleging that the allegations were politically motivated.

During the recent court sitting, Davis granted the confiscation order application for R71,500, which was presented by advocate Rajendrie Naidoo of the National Prosecuting Authority’s Asset Forfeiture Unit (AFU).

The AFU’s order was made under the Prevention of Organised Crime Act and sought to recover the benefits Luzulane had derived from her fraudulent actions.

The R71,500 that was confiscated had originally been allocated to the Ingwe Municipality’s poverty relief initiative, Operation Mbo.

Instead, the funds were diverted to three service providers for funeral expenses. Davis ordered Luzulane to pay the full confiscation amount into the Criminal Assets Recovery Account by January 30, one day before her sentencing.

Operation Mbo was a special project overseen by the mayor’s office, aimed at providing nutritious food parcels to needy families based on the recommendations of ward councillors. The initiative required proper documentation before the municipality authorized and facilitated the distribution of food parcels.

The conviction and impending sentencing of Nomagugu Luzulane highlight the serious consequences of misusing public funds. Such actions not only undermine the trust of the community but also hinder efforts to alleviate poverty and support those in need.

The court’s decision to confiscate the funds serves as a deterrent to others who may be tempted to engage in similar fraudulent activities.
