The DA’s court battle to test constituency of Disaster Management Act practiced by National Command Council (NCC) is in progress on the constitutional challenge.
DA Federal Leader John Steenhuisen said on Friday that Chief Justice has handed down a directive today.

He said the Constitutional Court (Concourt) will consider arguments in the DA’s application for direct access to challenge the Disaster Management Act in the highest court of the land.
”If the Disaster Management Act governing the lockdown does not meet constitutional muster, it means the decisions taken by the NCC under this Act are not valid,” said Steenhuisen.
Steenhuisen said this opens the way for more rationality and accountability in the management of this COVID-19 pandemic and of our economy going forward.

For the past weeks the federal party has been calling for government to end hard lockdown and to allow full operational sectors of economy.
If the Disaster Management Act does not meet constitutional muster, it means the decisions taken by the NCC under this Act are not valid.

Among other things, DA’s Federal believes President and NCC are abusing power to through Disaster Management Act as they believe it’s practiced irrational.
President also said he will not stop anyone from challenging regulations in court, should there be a need for court challenge.
