On December 3, 2022, Richard do Santos, a 35-year-old Mozambican national, was involved in a tragic incident that led to the murder of his girlfriend, Chrisandra Nxumalo.
The events unfolded at a local tavern in Volkrust, where a heated argument between the couple escalated into a fatal confrontation.
Eyewitnesses reported that the altercation quickly became violent, culminating in the brutal killing of Nxumalo. Emergency services were called to the scene, but tragically, Nxumalo was pronounced dead upon their arrival.
The subsequent police investigation into the murder uncovered critical information about do Santos.
It was revealed that he was residing in South Africa illegally, thus violating the country’s immigration laws.
This discovery added another layer to the case, as do Santos was not only facing charges of murder but also charges related to his illegal immigration status.
During the court proceedings at the Breyten High Court, do Santos pleaded guilty to both charges.
State Advocate Amos Mtshweni presented a compelling case, highlighting the pervasive issue of gender-based violence and femicide in South Africa. Mtshweni argued that such heinous acts deserved the harshest penalties to convey a strong message of zero tolerance towards gender-based violence.

A poignant moment in the courtroom was the victim impact statement delivered by Chrisandra Nxumalo’s mother.
The statement, facilitated by Court Preparation Officer Faith Masango, provided an emotional account of the devastating impact the murder had on the family.
The grief and loss experienced by Nxumalo’s loved ones were palpable, adding weight to the prosecution’s call for a severe sentence.
Judge Lindiwe Vukeya, in her sentencing remarks, emphasized the gravity of the crime and the absence of any substantial and compelling circumstances that might warrant a deviation from the prescribed minimum life sentence.
She underscored the need for justice to be served, particularly in cases of gender-based violence, thereby sentencing do Santos to life imprisonment for murder and an additional six months for immigration violations.
