Celebrity Chef Slapped With 10 Years In Jail For Defrauding SARS Of R3.1m

The Johannesburg Specialised Commercial Crimes Court handed down the sentence, with the fraud and money laundering charges running concurrently.

A renowned celebrity chef has been sentenced to 10 years in prison for defrauding the South African Revenue Service (SARS) of millions. Lusizo Mvula Henna, owner of Blaque Olive Chefs, was found guilty on six counts of fraud and 14 counts of money laundering.

The Johannesburg Specialised Commercial Crimes Court handed down the sentence, with the fraud and money laundering charges running concurrently.

It was revealed that Henna had claimed undue VAT refunds amounting to R5.3 million, of which SARS paid out R3.1 million. However, investigations showed that there were no corresponding trading activities in Blaque Olive’s bank accounts.

The court concluded that these claims were solely submitted to deceive SARS, and Henna quickly laundered the money within 14 days by transferring the proceeds to relatives and friends. Unfortunately, none of the R3.1 million has been recovered.

In presenting evidence on the damage caused by such schemes, the State highlighted the detrimental impact on the government’s ability to provide essential services. Crimes against the fiscus, like Henna’s, undermine the financial resources necessary for effective governance.

The National Prosecuting Authority (NPA) commended the efforts of the prosecutor and the investigation team in holding Henna accountable for his actions. The NPA emphasized that direct imprisonment was the appropriate punishment for crimes that steal from the fiscus.

This case serves as a stark reminder that no one is above the law, not even a celebrity chef. The sentencing of Lusizo Mvula Henna sends a clear message that fraudulent activities will not be tolerated, especially when they impact the country’s finances.
