Embattled former President, Jacob Zuma says he will open a criminal case against Billy Downer of the National Prosecuting Authority of South Africa (NPA), SurgeZirc SA reports.
Zuma has alleged that Downer was responsible for leaking his confidential medical records to some media houses during his hearing for medical parole.
Recall that SurgeZirc SA reported that the prosecution counsel representing the National Prosecuting Authority (NPA), Wim Trengove, during Zuma’s trial for contempt o court revealed that the ex-president was fit to appear in court for trial.
Trengove during proceedings told the KwaZulu-Natal High Court in Pietermaritzburg that they had issued subpoenas on several witnesses for Zuma’s medical records.
In response to the prosecution counsel statement, the defense counsel Dali Mpofu objected that Zuma’s medical records were not handed over.
Mpofu maintained that his client Zuma had rights to confidentiality and privacy. He argued that Zuma was not seeking to postpone court proceedings based on medical grounds.
In a statement issued by Zuma’s camp on Wednesday, it maintained that the actions of Downer were inappropriate as it contravenes some sections of the law.
“As indicated in court on 22/09/21, H.E Prez Zuma will be laying criminal charges against Adv Billy Downer SC for his admitted conduct which is in breach of sections 41(6) read with 41(7) of the NPA Act. The media is invited to a briefing outside SAPS in PMB on 21/10/21 at 13h00,” the statement reads.
Zuma’s counsels, Dali Mpofu SC and Thabani Masuku SC also alleged that Downer was responsible for leaking Zuma’s medical records to CIA spies.
However, there is an application from Zuma’s camp to remove Downer but judgment has be delayed as presiding Judge Piet Koen said he needed time to prepare a detailed judgment.
