Thabo Bester Won’t Back Down – Takes Prison Conditions Fight To ConCourt

Convicted serial rapist and murderer Thabo Bester has escalated his legal fight over his prison conditions, taking the matter to the Constitutional Court.

This move follows the Free State High Court’s dismissal of his attempt to challenge his incarceration conditions and request access to a laptop. In February 2025, the court ruled that Bester’s objection to the civil court’s jurisdiction lacked merit, effectively shutting down his case.

Bester Claims ‘Travesty of Justice’

According to SABC News, Bester’s legal team filed papers with the Constitutional Court on Monday, seeking permission to appeal the High Court’s decision. His attorney’s founding affidavit argues that the ruling is a “travesty of justice” and does not address the real legal issues at hand.

His legal team believes the decision sets a dangerous precedent, prompting them to challenge it at the highest level.

Parallel Appeal in High Court

While the Constitutional Court considers whether to hear the case, Bester has also filed a conditional application for leave to appeal before the Free State High Court, keeping multiple legal avenues open.

This latest legal manoeuvre adds another layer of complexity to his already high-profile case.

Bester remains at the centre of one of South Africa’s most shocking prison escapes, where he allegedly faked his death and fled custody. He and his co-accused now face multiple criminal charges related to the escape and other alleged crimes.

The Constitutional Court’s decision on whether to hear Bester’s appeal could set an important precedent for prisoner rights and jurisdictional disputes within South Africa’s legal system.
