Arrest and Investigation

The Welkom Serious Commercial Crime Investigation team captured Jessica and Petrus Janse Van Niewenhuys in Gqeberha on May 27, 2024, marking the beginning of their path to justice. This arrest followed a thorough investigation by the Hawks’ Serious Commercial Crime Investigation section, which is based in Welkom.

Details of the Fraud

Jessica, who worked as a bookkeeper for four companies in Parys from 2018 to 2022, was found to have participated in a complex conspiracy to defraud SARS. She submitted bogus tax returns on behalf of these firms as well as her husband, who worked for a mining company. These fraudulent acts resulted in a loss of more than R9 million for SARS.

Court Verdict and Sentencing

The High Court found Jessica Marieka Janse Van Niewenhuys guilty of 181 counts of fraud and 38 counts of money laundering. The court combined all counts for sentencing, resulting in a 12-year jail term. Furthermore, she was judged unfit to possess a handgun, indicating the gravity of her offences and the potential threat she poses to society.

Hawks’ Response and Future Actions

Major General Mokgadi Bokaba, Free State Director of the Directorate for Priority Crime Investigation (Hawks), praised the sentencing as a stern warning to future offenders. She also praised the combined efforts of all parties engaged in obtaining the hefty sentence. “A process to recoup what was benefited from this crime is underway,” she said.
