Supreme Court Upholds King Misuzulu’s Recognition, Overturns High Court Ruling

The Supreme Court of Appeal (SCA) has overturned the Pretoria High Court’s judgment that had nullified the recognition of King Misuzulu kaZwelithini as the Zulu monarch.

This latest ruling brings an end to months of legal uncertainty surrounding the Zulu throne. In December 2023, Judge Norman Davis of the Pretoria High Court sided with Princes Mbonisi and Simakade Zulu, who challenged King Misuzulu’s recognition by President Cyril Ramaphosa.

Both the President and King Misuzulu appealed the ruling earlier this year, taking the matter to the Supreme Court of Appeal in Bloemfontein.

President Cyril Ramaphosa formally recognised King Misuzulu kaZwelithini as the rightful monarch in March 2022. However, several members of the Zulu royal family opposed the decision, arguing that the recognition process was flawed and lacked procedural compliance.

The Pretoria High Court initially agreed with their challenge, stating that proper steps were not followed when the President confirmed the King’s recognition.

Court Rules in Favour of the King and the President

After hearing arguments from both sides, the Supreme Court of Appeal ruled that all legal and customary processes were correctly observed in the recognition of King Misuzulu. The court found that the Zulu royal family had indeed identified him as their chosen monarch, and President Ramaphosa’s role was to formalise that decision.

The SCA’s decision not only reinstates King Misuzulu’s recognition but also orders the respondents—Princes Mbonisi and Simakade—to cover the costs of the appeal.

This judgment effectively reaffirms King Misuzulu’s position as the undisputed leader of the Zulu nation.
