Shebeshxt Denied Bail Again As Court Finds No New Evidence

The Polokwane Magistrate’s Court has refused bail for controversial Limpopo artist Lehlogonolo Chauke, popularly known as Shebeshxt.

Magistrate Godfrey Netshiozwi ruled that the artist’s third bail application did not introduce new facts amounting to exceptional circumstances.

As a result, Chauke remains in custody.

Court Finds ‘New Facts’ Argument Unconvincing

In his ruling, Netshiozwi found that the defence had failed to prove that the information presented was materially different from what had already been considered in earlier bail proceedings.

“The so-called new facts relied upon are, in substance, an embroidery of circumstances that were already known and considered at the time of the initial bail application,” the court found.

The magistrate emphasised that renewed bail applications must be based on genuine changes in circumstances, not a rehash of previously assessed claims.

Shebeshxt Remains in Custody Pending Trial

The court applied Section 60 of the Criminal Procedure Act 51 of 1977 and Section 35(1)(f) of the Constitution, which require an accused person to demonstrate that release is in the interests of justice.

It ruled that Chauke had not met this requirement, finding no exceptional circumstances to justify bail.

The State opposed the application, arguing that the issues raised — including medical and personal factors — had already been presented in earlier hearings.

The court confirmed that, without new facts, the previous decision to deny bail stands, meaning Chauke will remain behind bars until trial.

Netshiozwi added that the accused may approach a higher court if genuinely new facts arise in future, but based on the current record, release is not justified.
