Shamila Batohi Rejects Final Terms Of Reference As Chauke Inquiry Intensifies

The National Prosecuting Authority (NPA) head, Shamila Batohi, has made it clear she does not stand by the final Terms of Reference issued by President Cyril Ramaphosa for the inquiry into Johannesburg prosecutions chief Andrew Chauke’s fitness to remain in office.

Batohi appeared before the inquiry this week, where she was questioned about her role in initiating the investigation into allegations that Chauke took politically influenced prosecutorial decisions.

Although she filed the initial complaint with President Ramaphosa, Batohi told the inquiry that the terms released by the Presidency were not the same as the version she had submitted.

“We did submit a draft to the President but what the President adopted subsequently is quite different from the draft and we didn’t input any draft that the President had,” Batohi said.

The panel pressed her several times to link her allegations directly to the inquiry’s Terms of Reference. Batohi conceded that she had not properly acquainted herself with the final document.

Inquiry Seeks Clarity on Draft Shamila Batohi Submitted to President

The inquiry has now asked Batohi to provide the draft that was originally sent to the President. This will be compared with the adopted Terms of Reference to determine how the scope of the inquiry may have shifted.

Focus Sharpens on Allegations Against Chauke

The comparison is expected to help the inquiry pinpoint the key accusations that prompted the investigation into Chauke, who faces claims of allowing political considerations to influence prosecutorial decisions.
