Shadrack Sibiya Faces New Firearm Charge And Two More Disciplinary Notices

The suspended deputy national police commissioner’s legal team told the Randburg Magistrate’s Court that he was served with additional disciplinary notices while in custody.

Suspended Deputy National Police Commissioner Shadrack Sibiya is facing another legal development after his lawyers told the Randburg Magistrate’s Court that he has been charged with possession of a firearm.

The firearm charge relates to a gun allegedly found in Sibiya’s possession on the day he was arrested.

His legal team argued that the firearm allegation should have been included with the other charges rather than being brought separately, as his bail application continued on Thursday.

Shadrack Sibiya Served With New Disciplinary Notices

Shadrack Sibiya was also reportedly served with two additional disciplinary notices while in custody, adding to an earlier notice issued by the South African Police Service.

His lawyers told the court that Sibiya had left one of the notices in his cell and could not remember the date of the disciplinary hearing.

The defence indicated that it would deal with the issue once it had obtained the relevant information, while the exact nature of the two additional disciplinary notices was not immediately clear.

Sibiya was arrested last week by members of the Commission Recommendations Task Team, which is investigating matters arising from the Madlanga Commission.

Shadrack Sibiya Faces October Disciplinary Hearing

Shadrack Sibiya’s disciplinary proceedings are already scheduled to begin on October 5, according to SAPS.

National police spokesperson Brigadier Athlenda Mathe previously confirmed that Sibiya had been formally served with notice while in police custody.

The internal hearing relates to allegations arising from the Madlanga Commission inquiry and will be conducted on an expedited basis under Regulation 9, which SAPS said applies to serious allegations including corruption.

Sibiya has previously raised concerns that remaining in custody could affect his ability to participate fully in the disciplinary process.

He told the court that the hearing concerned his continued employment and argued that he needed an opportunity to prepare with his legal representatives.

Shadrack Sibiya Bail Hearing Continues

Shadrack Sibiya’s bail application relates to five charges, including rape, sexual grooming and human trafficking.

The state alleges that Sibiya raped an 18-year-old woman at a Sandton hotel on May 16 after she had allegedly been given alcohol and lost consciousness.

He is also accused of sexually grooming a 16-year-old girl through WhatsApp between July and August, with the state alleging that he possessed and distributed sexually explicit images involving the teenager.

The state further alleges that Sibiya trafficked three people for sexual exploitation.

Sibiya has denied the allegations and previously described the charges as “trumped up”, while also questioning the Commission Recommendations Task Team’s involvement in the case.

His bail proceedings are continuing before the Randburg Magistrate’s Court.
