Moroadi Cholota Says She’s Not Guilty And Being Unfairly Punished For Not Cooperating In Zondo Inquiry

Moroadi Cholota, the former personal assistant to Free State Premier Ace Magashule, has become embroiled in a legal battle following her extradition from the United States.

Allegedly linked to a R255 million corruption case, Cholota made her first appearance at the Bloemfontein Magistrate’s Court on Monday to apply for bail. This marks yet another chapter in South Africa’s extensive efforts to crack down on corruption within its ranks.

Appearing calm but visibly upset, Cholota listened intently as the court decided against her immediate release on bail. Advocate Loyiso Makapela, representing Cholota, argued vigorously that her prolonged detention was unlawful.

He pointed out that Cholota had already spent nearly four months in custody in the U.S. before her extradition to South Africa.

In her affidavit, Cholota declared her innocence, emphasizing that she is not guilty of the charges of fraud, corruption, and money laundering.

Cholota contended that she had been unfairly punished for allegedly not cooperating fully with investigators during the inquiry led by Chief Justice Raymond Zondo in 2019. She stated that she had been informed she would be a state witness and was only charged after a perceived lack of cooperation.

According to Cholota, there was no substantial evidence linking her to any wrongdoing, either in the Zondo Commission or other investigative reports.

Despite Cholota’s request for bail to be set at R2,500, the National Prosecuting Authority (NPA) requested a postponement to review her affidavit thoroughly. The court adjourned the case to Tuesday, allowing both sides to prepare their arguments more comprehensively.

U.S. Judge Erin Aslan, who approved the extradition, had previously stated that there was sufficient evidence to warrant Cholota’s involvement in schemes that facilitated corrupt financial transactions. As the legal proceedings continue, both sides prepare for a trial that promises to shed light on the intricate web of corruption charges Cholota faces.
