NPA Withdraws Charges Against Crime Intelligence Boss Dumisani Khumalo And Co-Accused

The National Prosecuting Authority (NPA) has withdrawn criminal charges against Crime Intelligence head Lieutenant-General Dumisani Khumalo, Brigadier Dineo Mokwele, Major-General Nozipho Madondo and their co-accused.

The decision follows a directive issued by National Director of Public Prosecutions (NDPP) Advocate Andy Mothibi, who instructed that the prosecution should not proceed at this stage.

NPA Withdraws Charges Pending Further Investigation

The charges were withdrawn before any of the accused entered pleas in court. According to the NPA, the decision was taken because investigations are still ongoing and prosecutors do not yet have a complete evidentiary record to proceed.

Mothibi has also directed that the matter cannot be reinstated without his written approval.

Should the Investigating Directorate Against Corruption (IDAC) later recommend that criminal charges be pursued, Khumalo and the other officials will first be afforded an opportunity to respond before any further prosecutorial decisions are made.

Crime Intelligence Arrest Process Triggered Complaints

The withdrawal comes after controversy surrounding the attempted arrest of Khumalo. The process prompted complaints to both the Minister of Justice and the Minister of Police.

IDAC had previously confirmed that a warrant of arrest had been issued. However, the planned arrest did not go ahead.

Khumalo and Madondo later sought explanations from IDAC over the handling of the matter. They questioned why investigators had not obtained warning statements from them before the arrest process was initiated.

The senior officers also raised concerns about being instructed to report to Brooklyn Police Station in Pretoria with clothing for possible detention, despite the arrest not taking place.

Andrea Johnson's Resignation Follows High-Profile Investigation

The officials further criticised what they described as a lack of communication regarding the aborted arrest. They also requested that authorities provide proper notice should any future action be taken against them.

The latest development comes shortly after the resignation of former IDAC head Advocate Andrea Johnson, who had overseen the investigation before stepping down from her position.

The NPA has not indicated whether or when a final decision on possible future prosecutions will be made.
