NPA Confident In Appeal Against Timothy Omotoso After Gqeberha Court Reserves Judgment

The National Prosecuting Authority (NPA) has expressed confidence in its appeal bid against Nigerian televangelist Timothy Omotoso, following a reserved judgment by the Gqeberha High Court in the Eastern Cape.

The court reserved its decision on Monday in a case challenging the acquittal of Omotoso and his co-accused on multiple serious charges. These included over 60 counts of rape, human trafficking, and racketeering.

During the hearing, the State argued that the court had erred in clearing Omotoso and his associates of the charges, maintaining that a legal mistake had been made in their acquittal.

State Argues Acquittal Was a Judicial Error

According to the prosecution, the decision to absolve Omotoso and his co-accused was based on what it described as a misjudgment of the evidence presented during trial. The NPA insists the initial ruling overlooked crucial aspects of the case and failed to deliver justice to the victims.

“The State submitted that the acquittal of Omotoso and his co-accused was an error in judgment,” the NPA’s legal representatives told the court.

However, the defence argued that the NPA’s appeal application was flawed, claiming it misinterpreted the original judgment and failed to adhere to procedural standards.

“The defence maintains that the NPA’s application misinterpreted the main judgment and failed to meet procedural requirements,” they said in court.

The case now lies in the hands of the Gqeberha High Court, which will determine whether it can be referred to the Supreme Court of Appeal for further consideration.
