Nota Baloyi’s Controversial Remarks Ignite Legal Firestorm

South African music executive Nhlamulo “Nota” Baloyi has ignited a legal and public relations storm following incendiary comments made during a podcast interview. 

His statements have prompted the South African Human Rights Commission (SAHRC) to take decisive action, underscoring the nation’s commitment to combating hate speech.​

During a February 17, 2025, episode of “The Hustlers Corner SA” podcast, hosted by DJ Sbu, Baloyi made inflammatory assertions regarding white individuals.

He stated, “White people are an inferior species to us. We’re Homo sapiens; they have got Neanderthal blood in them. This is the science. This science was not done by black people; it was done by them.” 

These remarks quickly gained widespread attention, leading to public outcry and multiple complaints to the SAHRC. 

SAHRC’s Legal Response and Demands

In response to the uproar, the SAHRC initiated an own-accord investigation, confirming the receipt of several complaints against Baloyi. The Commission determined there was a prima facie case of hate speech and announced plans to institute proceedings in the Equality Court. 

The SAHRC’s demands include a public apology, diversity and sensitivity training, community service, and a monetary fine. Additionally, the Commission suggested that complainants seeking further remedies could pursue a crimen injuria case with the South African Police Service. 

Baloyi’s Defiant Stance Amidst Backlash

Despite the mounting pressure, Baloyi has remained unrepentant. He equated his situation to that of political figures Julius Malema and Andile Mngxitama, stating, “I take the referral of this matter to the Equality Court very seriously, as I join Julius Malema and Andile Mngxitama as other notable figures that have exposed the fragility of whiteness.” 

Baloyi further asserted, “I cannot apologise for stating facts, and I am glad to have been able to give those with Neanderthal ancestry a much-needed racial sensitivity crash course.” 

Baloyi’s remarks have sparked significant backlash from the public and various organizations. Social media platforms have been flooded with condemnations, with users highlighting the inappropriateness and divisiveness of his statements. 

The incident has reignited discussions about the boundaries of free speech and the responsibilities that come with public platforms. ​

Implications for Freedom of Expression

This case underscores the delicate balance between freedom of expression and the prohibition of hate speech in South Africa. While the Constitution upholds the right to free speech, it explicitly excludes expressions that constitute propaganda for war, incitement of imminent violence, or advocacy of hatred based on race, ethnicity, gender, or religion.
