Nkabinde Enquiry Resumes As Andrew Chauke’s Fitness To Hold Office Comes Under Fresh Scrutiny

The Nkabinde Enquiry, which is assessing the fitness of suspended South Gauteng Director of Public Prosecutions Advocate Andrew Chauke to remain in office, is set to resume in Pretoria today.

Uncertainty surrounds whether National Director of Public Prosecutions Shamila Batohi, who is due to retire next week, will once again take the witness stand when proceedings get underway.

Batohi stepped away from the public hearings last month after a tense exchange during cross-examination by Advocate Tembeka Ngcukaitobi, who is appearing on behalf of Chauke.

Advocate Ngcukaitobi represents Chauke, who has been accused by Batohi of making questionable decisions in several high-profile cases, allegations that lie at the centre of the inquiry.

Enquiry spokesperson Tiyisela Mpuzana confirmed that proceedings will continue with further testimony and submissions.

“The Nkabinde Enquiry will resume its public hearing following the festive adjournment. The enquiry forms part of the mandate to inquire fitness of Advocate Andrew Chauke to hold office of DPP of South Gauteng.

“As proceedings resume, evidence will continue to be led through evidence leaders as well as witnesses to be called by the legal team of Advocate Chauke in accordance with the inquiry’s mandate,” Mpuzana said.
