Accused In Kiernan ‘AKA’ Forbes Murder Case Complains About Mistreatment In Custody

During the court proceedings, the state requested a postponement to allow for further investigations. State prosecutor Lawrence Gcaba explained that the analysis of obtained data and the extradition of two additional suspects from eSwatini were still ongoing.

One of the men accused of killing Kiernan “AKA” Forbes and his friend, Tebello “Tibz” Motsoane, has lodged a complaint about mistreatment while in custody.

The murder case, involving five out of the seven suspects arrested in connection to the murders, was briefly heard in the Durban Magistrate’s Court. The accused face multiple charges, including conspiracy to commit murder, two counts of murder, attempted murder, and unlawful possession of a firearm and ammunition.

During the court proceedings, the state requested a postponement to allow for further investigations. State prosecutor Lawrence Gcaba explained that the analysis of obtained data and the extradition of two additional suspects from eSwatini were still ongoing.

Gcaba stated that the extradition process had already commenced and could take up to two months, depending on the cooperation between the parties involved.

The magistrate ordered the accused to remove their masks, as there was no pending identification parade. It was proposed that some of the accused be detained at the Chatsworth Police Station, while the others were already serving sentences at Westville Prison for unrelated crimes.

However, it was revealed that one of the accused had complained about mistreatment at Chatsworth Police Station.

The magistrate instructed the accused to address their complaint with the station commander and the investigating officer. The case was postponed to March 6, 2024, for bail verification, with arguments on the bail applications scheduled for March 14.

The magistrate acknowledged that the case might not be finalised on those dates and set additional dates for bail application purposes, taking into account the availability of legal representatives and the prosecution team.

The state expressed its intention to oppose the accused’s release on bail should an application be filed with the court.
