Modack Trial: WhatsApp Messages Reveal Alleged Plot To Hire Three Hitmen For Kinnear Murder

State prosecutors have presented new digital evidence in the Western Cape High Court, alleging that murder accused Zane Kilian arranged three armed hitmen for Nafiz Modack to target top anti-gang investigator Lieutenant Charl Kinnear.

Kinnear was gunned down outside his Bishop Lavis home in September 2020. Both Modack and Kilian are charged with his murder, forming part of a sprawling case that includes 122 charges against Modack and 14 co-accused.

On Monday, State prosecutor Greg Wolmarans introduced WhatsApp screenshots retrieved from Kilian’s phone.

The June 2020 messages—sent three months before Kinnear’s assassination—show Kilian messaging a contact listed as “Modack 2020”, stating that he could organise “three armed hitmen”.

In court, Wolmarans highlighted the content of the messages: “He’s talking about armed hitmen. Three hitmen. And it’s going to cost R1,500 each. Do you see that? This doesn’t sound good, hey.”

Modack denied any involvement in such discussions, telling the court: “At no stage did myself and Kilian discuss that, my lord.”

Prosecution Links Messages To Kinnear Tracking

Wolmarans further told the court that, over a 63-day period, Kilian used four of seven different variations of Modack’s name when communicating about tracking Kinnear’s movements.

The prosecution argues this pattern shows deliberate attempts to conceal communication during the build-up to the murder.

The trial continues.
