Meta Wins Landmark Antitrust Case, Avoids Potential Breakup Of Instagram And WhatsApp

Meta Wins Landmark Antitrust Case, Avoids Potential Breakup Of Instagram And WhatsApp

Meta has secured a decisive victory in a high-stakes antitrust case that once posed a significant threat to the company’s future.

A US federal judge ruled on Tuesday that the Federal Trade Commission (FTC) had not successfully demonstrated that Meta holds monopoly power in the social media market.

The FTC first brought its antitrust lawsuit in 2020, during President Donald Trump’s administration.

The agency argued that Meta — then known as Facebook — harmed consumers by buying Instagram and WhatsApp, acquisitions it claimed suppressed competition in the digital marketplace.

Meta defended the purchases as essential investments that helped both platforms expand, pointing to TikTok’s rapid rise as evidence of a competitive landscape.

On Tuesday, US District Judge James Boasberg sided with Meta, concluding that the FTC failed to meet the legal threshold required to prove an ongoing monopoly. “Whether or not Meta enjoyed monopoly power in the past, though, the agency must show that it continues to hold such power now,” he wrote.

“The Court’s verdict today determines that the FTC has not done so.” The ruling blocks an outcome that could have forced Meta to unwind its Instagram and WhatsApp acquisitions. The FTC may still appeal, though the agency has not indicated whether it will pursue further action.

Judge Finds TikTok and YouTube Undercut Monopoly Claims

In its case, the FTC attempted to define “personal social networking” apps as a narrow market category including Snapchat and MeWe. However, Judge Boasberg determined that the dominance of TikTok — and to an extent YouTube — could not be overlooked.

He wrote, “PSN [personal social networking] apps may have been a market unto themselves when the FTC filed this case in 2020 or when it approved Facebook’s acquisitions of Instagram and WhatsApp in 2012 and 2014.

“That is no longer the case. The Court ultimately finds that YouTube and TikTok belong in the product market, and they prevent Meta from holding a monopoly. Even if YouTube is out, including TikTok alone defeats the FTC’s case.”

Top Executives Testify on Competition Pressures

The weeks-long trial saw testimony from several high-profile figures, including Adam Mosseri, Sheryl Sandberg, Kevin Systrom and Mark Zuckerberg.

Zuckerberg told the court that TikTok’s emergence created intense pressure, noting that Meta’s growth had “slowed down dramatically” as the short-form video platform surged in popularity.

Following the ruling, Meta issued a statement saying, “The Court’s decision today recognises that Meta faces fierce competition.

“Our products are beneficial for people and businesses and exemplify American innovation and economic growth. We look forward to continuing to partner with the Administration and to invest in America.”
