Malawi Court Rules Bushiri And Wife Must Be Extradited And Face Charges In South Africa

A Malawi court has ruled that South Africa meets the legal requirements to extradite self-proclaimed “prophet” Shepherd Bushiri and his wife, Mary Bushiri, to face multiple criminal charges, including fraud and money laundering.
Extradition Case and Charges
The Bushiris fled South Africa in November 2020 while out on bail for an alleged R102 million investment fraud scheme. South Africa requested their extradition to face 13 charges, including rape, violations of immigration laws, and financial crimes.

The court considered 10 of the 13 charges presented and found that four were sufficient to justify extradition. Malawi’s Ministry of Justice confirmed the ruling, stating that it reinforces international legal cooperation and accountability.
Bushiri’s Reaction and Appeal Plans
Following the ruling, Bushiri claimed a “remarkable victory” on social media, asserting that 10 of the charges had been dismissed due to “lack of evidence.” The couple has filed an appeal, and the court has granted a 30-day stay order while they seek relief from the High Court.

Despite the magistrate court lacking jurisdiction to grant bail to fugitives, the couple remain out on bail. Their defence team is expected to formally apply for bail during the stay order period.
“They further applied for a 30-day stay order on the ruling, which the court granted. The court referred the matter of bail to the High Court, as the magistrate’s court does not have jurisdiction to grant bail to fugitives. The defence is expected to apply for bail during the stay order, as directed by the magistrate’s court. This means the Bushiris will remain out on bail.”

Justice Minister Mmamoloko Kubayi welcomed the ruling and confirmed that South Africa would oppose any appeal. If the couple’s appeal is unsuccessful, South African authorities will work with Interpol and SAPS to coordinate their extradition. The state will cover all associated costs.
