Madlanga Warns Feroz Khan’s Lawyer Over ‘Speculative’ Claims About Commission

Justice Mbuyiseli Madlanga has cautioned the legal team representing suspended Crime Intelligence deputy head Feroz Khan against making public statements that could cast doubt on the integrity of the Madlanga Commission of Inquiry.

The warning follows comments made by Khan’s lawyer after the senior police officer was shot in Houghton on Sunday, days before he was scheduled to appear before the commission on Wednesday, 1 July. Police are investigating the circumstances surrounding the shooting.

Madlanga Commission Warns Against Speculative Claims

Speaking to the media outside the hospital where Khan is receiving treatment, Advocate Zubair Khan expressed concern about the safety of witnesses involved in the inquiry.

He referred to the killing of a previous witness and the shooting of General Khan, while acknowledging that his concerns were not backed by evidence.

“One person who appeared before the commission has already been murdered as we know. There’s been an attempt on General Khan’s life as he was to appear before the commission, and there is grave concern that there might be a compromise from within the commission. But, at this stage its speculative.”

Justice Madlanga responded by warning the advocate against making similar remarks in future.

“If you are ever to make media briefings again, be careful of what you say. Don’t say anything that may tend to impugn the integrity of this commission.”

Advocate Khan subsequently offered an unconditional apology to the commission.

Feroz Khan’s Evidence To Be Heard Despite Hospitalisation

The commission confirmed that evidence concerning Khan will still be presented on Friday, even though he is unable to attend the proceedings.

His legal representatives informed commissioners that Khan remains sedated and in a critical condition following Sunday’s shooting.

Evidence leader Adila Hassim SC said the commission would follow the same procedure previously used for Medicare24 CEO Mike van Wyk. She explained that Khan would be given an opportunity to respond to the evidence presented once he is able to do so.

Feroz Khan Withdraws Bid For Private Commission Hearing

Khan’s legal team also withdrew its application for him to testify in camera after commissioners questioned its merits.

The commission indicated that the application lacked sufficient grounds to justify a closed hearing.

“I have said it’s vague; I could actually go further and say it’s hopeless.”

Following the commission’s remarks, Khan’s lawyers withdrew the application while awaiting further instructions from their client on whether to submit a revised request.
