Madibeng Mayor’s Bodyguards To Learn Bail Outcome In R80 Mabopane Highway Murder Case

Two bodyguards assigned to Madibeng Mayor Douglas Maimane are set to find out on Friday whether they will be released on bail after the court reserved judgment following closing arguments.
The bail application relates to a January incident on the R80 Mabopane Highway, where South African Air Force Sergeant Michael Swanton was shot and killed. The two accused were arrested shortly after the incident.
They face charges of murder, defeating the ends of justice, and driving a vehicle fitted with blue lights without authorisation.
Mayor’s Bodyguards Bail application hinges on Schedule 6 requirements
During closing submissions, the State argued that the accused had failed to demonstrate exceptional circumstances as required for bail in a Schedule 6 offence.
Advocate Chris Marumo, appearing for the prosecution, told the court that being employed and supporting children did not meet the legal threshold.
Marumo stressed that the law defines exceptional circumstances as something unusual and extraordinary, not conditions commonly faced by many accused persons.

“The deceased in this matter was a father to two kids whom he was also maintaining; his kids lost their father.

“The court defined exceptional circumstances as something unparalleled, something unusual and extraordinary. I regard the submission that they are employed as ordinary circumstances,” Marumo said.
Forensic and ballistic evidence under scrutiny
The court also heard that forensic findings and a ballistic report will play a key role in the case as it proceeds.
Marumo said these reports would determine whether any of the weapons found in the suspects’ possession were used in the fatal shooting.
At the time of their arrest, the two accused were found with two pistols and a rifle.
The court is expected to deliver its decision on bail on Friday.
