Lynn Forbes Faces Ndimande Brothers In Court As They Question Their Own Extradition

Lynn Forbes made an emotional appearance at the Durban Magistrate’s Court on Tuesday,  and her presence immediately intensified the already heavy atmosphere as the Ndimande brothers, Siyabonga Gezani and Malusi Dave, made their second appearance and pushed the case into fresh drama.

Recently extradited from Eswatini after abandoning their attempt to stay there, the brothers are now insisting they cannot give proper instructions to their legal team without full details of their extradition process.

Their advocate, Simphiwe Mlotshwa, said the brothers “require information regarding the extradition” before they proceed, adding that a formal request had already been sent to the State.

When Magistrate Irfaan Khalil pressed for clarity, Mlotshwa confirmed the information was needed for multiple aspects of the defence.

The brothers were arrested in Mbabane in 2024 by the Royal Eswatini Police Service, handed over at King Shaka International Airport earlier this month, and charged in connection with the murders of Kiernan “AKA” Forbes and Tebello “Tibz” Motsoane outside Wish Restaurant on Durban’s Florida Road in February 2023.

State Pushes Back as Defence Demands More Information

Deputy Director of Public Prosecutions Lawrence Gcaba confirmed that conversations had taken place with the defence and said the State would provide what it could — “if we have the information they are requesting.”

His wording hinted at possible gaps or disputes over what qualifies as relevant extradition material. Both sides agreed to postpone the matter to 9 January 2026, when the court will lay out the next steps.

The case continues to expand as more co-accused enter the fold.

Lynn Forbes Attends Hearing and Leaves Court in Tears

In a highly emotional moment, Lynn Forbes attended the hearing for the first time since all accused men were arrested.

Watching the proceedings intensely, she thanked Gcaba and the State team for their work, signalling her ongoing trust in the prosecution. But when the session ended, Lynn appeared visibly shaken.

Though she had promised the media a statement, she left the courtroom in tears, escorted by armed police officers who remained close to her throughout the proceedings.

The Ndimande brothers are expected to join their co-accused — Lindokuhle Thabani Mkhwanazi, Lindani Zenzele Ndimande, Siyanda Eddie Myeza, Mziwethemba Harvey Gwabeni, and Lindokuhle Lindo Ndimande — in the Durban High Court in July next year, where the high-profile trial is set to finally unfold.
