Illness Forces Kelly Smith To Leave Court, Proceedings Continues Without Her

Kelly Smith, one of the accused in a high-profile case, was excused from Thursday’s court proceedings after experiencing a sudden medical emergency.

Judge Nathan Erasmus informed that Smith had fallen ill and would not be able to attend the trial.

Her legal representative, Rinesh Sivnarain, confirmed that Kelly preferred immediate medical attention and would not participate for the day.

Court Approves Absence For Medical Reasons

Judge Erasmus ruled that the proceedings would continue in Kelly Smith’s absence, citing provisions in the Criminal Procedure Act that allow for such situations.

He emphasized that the trial within a trial did not involve the third accused, and therefore, her absence would not disrupt the ongoing legal process.

“Arrangements have been made for her to receive medical care immediately,” Judge Erasmus added.

Smith, visibly in distress, was escorted out by two police officers.

She appeared to be struggling to walk, leaning on the officers for support as she left.

Her co-accused seemed concerned but remained silent as she was taken from the courtroom.

State Witness Testifies, Trial Progresses

Meanwhile, the trial continued without Smith as the State called Colonel Edward Clark from the Western Cape Serious and Violent Crimes Unit to testify.

Clark is expected to present crucial evidence, including footage of Steveno van Rhyn’s confession, which will play in court.

The trial is expected to proceed as planned despite the brief interruption.
