Joshlin SmithTrial: Confessions Under Scrutiny As Defense Claims Coercion,Torture In Obtaining Statements

The validity of confessions made by the accused in the Joshlin Smith disappearance case has been called into question by defense attorneys, who argue that they were obtained under duress, coercion, and torture.

Detective Captain Wesley Lombard, who was responsible for the handling of the accused, denied any allegations of assault during cross-examination.

The trial, ongoing in the Limpopo High Court, has now shifted focus to the treatment of the accused during their detention and whether their confessions were made freely.

Disappearance Of 6-Year-Old Joshlin Smith

Joshlin Smith, a six-year-old girl, was reported missing from her Middelpos home on February 19. Her mother, Racquel ‘Kelly’ Smith, her boyfriend Jacquen ‘Boeta’ Appollis, and Steveno ‘Steffie’ van Rhyn are currently on trial, facing charges of kidnapping and human trafficking related to her disappearance.

Lourentia ‘Renz’ Lombaard, once an accused party, in the case of missing Joslin Smith was granted immunity as a State witness, providing testimony against the remaining suspects.

The case has attracted significant media attention, with questions surrounding the handling of the confessions that were used as evidence.

Allegations Of Torture And Coercion

Defense attorney for one of the accused, Lombaard, insisted that her client had not voluntarily made a confession and that the statements were dictated to him.

She further claimed that her client had been tortured, including being beaten and having his private parts pinched during interrogation to the whereabout of Joshlin Smith at Jacobsbaai beach.

The defense has called these confessions into question, arguing that undue influence was applied to extract the statements.

Judge Erasmus noted that the court would address these claims through a “trial within a trial,” with further witnesses potentially being called to support or dispute the allegations.

Police Deny Assault Allegations

During cross-examination, Captain Lombard denied that any assaults occurred in his presence.

When asked about accusations of Boeta having a blue eye, Lombard stated that Boeta denied being assaulted.

Lombard confirmed that none of the accused had reported any assaults, and he had not seen any physical injuries.

The judge also probed Lombard on whether he had influenced any of the confessions and whether he had received the necessary documentation.

The trial continues as further evidence is presented and the questioning of police procedures intensifies.
