The court found that the man, who lived on the same property as the victim and her mother, raped the girl on two separate occasions in September and November 2024.

National Prosecuting Authority spokesperson for KwaZulu-Natal, Natasha Ramkisson-Kara, detailed the accused’s methods.

“After raping her he would threaten to kill her and her mother if she told anyone what he had done. He further threatened to bewitch her with ‘muthi’ that he had obtained from his home country,” said Ramkisson-Kara. The assaults occurred after the man called the girl into his room.

Case Revealed Through Mother’s Intervention

The cycle of abuse was broken when the traumatised child found the courage to confide in her mother.

“The matter eventually came to light when the complainant confided in her mother. The mother then told the landlord what had happened, and the police were called,” Ramkisson-Kara stated.

The accused was promptly arrested, and the young victim received crucial medical attention at a nearby hospital.

The state built a solid case, with Prosecutor Khanyi Sabelo leading the testimonies of four witnesses: the complainant, her mother, the landlord, and the examining doctor.

In addition to the two life imprisonment terms for rape, the man received a 12-month sentence for contravening the Immigration Act, which will run concurrently with his life sentences.

The court also ordered that his name be entered into the National Register for Sex Offenders and declared him unfit to possess a firearm.

The sentence considered the profound impact on the victim, who stated in her Victim Impact Statement that she feels embarrassed and cannot move past the trauma.

Her mother noted the girl’s behaviour has become disruptive and rebellious since the incidents.
