IEC Chair Mosotho Moepya Wins Defamation Case Against Nephew Over Adultery And Rape Cover-Up Allegations

Electoral Commission of South Africa (IEC) chairperson Mosotho Moepya has emerged victorious in a defamation battle against his nephew, Sylvester Mashilo Mokubedi, following explosive allegations of adultery and covering up for abusers within the family.

Moepya approached the Gauteng High Court in Johannesburg to stop Mokubedi from posting defamatory claims on Facebook. Mokubedi, whose late mother was married to Moepya’s brother, published several posts accusing the IEC chair of being a “rape apologist” and “protecting a family of abusers and rapists.”

One of the most controversial posts alleged that Moepya had “condoms hidden in the boot of his Mercedes-Benz” and should explain this to his wife.

Judge Mokate Noko ruled in Moepya’s favour last week, declaring the statements defamatory. Mokubedi was ordered to permanently delete the offending posts, refrain from publishing similar content, and issue a public apology to Moepya, the IEC, President Cyril Ramaphosa, and the political parties tagged in his posts.

The court also ordered Mokubedi to pay legal costs, including counsel fees on scale B.

Mokubedi Fights Back With Appeal Over Emotional Distress

Despite the ruling, Mokubedi has filed two applications for leave to appeal, arguing that the judge made several legal and factual errors. He has also applied to stay the enforcement of the judgment pending the outcome of his appeal.

In his court papers, Mokubedi claims that his statements were made during a period of “profound emotional distress” after being excluded from his mother’s funeral rituals. He insists that the posts stemmed from “acute sorrow, grief, and anger,” arguing that this emotional turmoil should negate any intention to injure Moepya’s reputation.

According to Mokubedi, his mental state was significantly impaired by grief and ongoing family conflict, which affected his ability to act rationally. He argues that the common law of defamation should evolve to recognise diminished intent caused by emotional trauma—similar to defences of provocation in criminal law.

He further claimed that being forced to apologise publicly before his appeal is heard would cause irreversible reputational damage, stating:

“If the stay is not granted, I will suffer irreparable harm in that the order requires me to publish an unreserved apology within 24 hours… Should my appeal succeed, the harm caused by publication of the apology cannot be undone.”

Mosotho Moepya Denounces Damaging Accusations

In his affidavit, Moepya expressed deep concern over the impact of the Facebook posts, describing them as portraying him as “complicit in rape” and “unethical, immoral, and unlawful.”

He said the allegations suggested he had shielded rapists and abusers, damaging his reputation both personally and professionally. Regarding the post about the condoms, Moepya said it painted him as “dishonest to his wife, a cheat, and an adulterer.”

Moepya’s current term as IEC chairperson ends this month. He is among eight candidates shortlisted for three commission vacancies—a process now unfolding under heightened public scrutiny following the family feud.
