Suspended SAPS Sergeant Fannie Nkosi Denied Bail In Corruption Case

The Pretoria North Magistrate’s Court has refused bail for corruption-accused South African Police Service (SAPS) member, Sergeant Fannie Nkosi.

Magistrate Thandi Theledi ruled that Nkosi failed to convince the court that he would not pose a threat to the public, attempt to evade trial, or interfere with ongoing investigations and witnesses.

The 43-year-old officer, who is currently suspended from the SAPS Organised Crime Unit, is facing multiple charges, including obstruction of justice.

Schedule 5 Charges Place Burden on Fannie Nkosi

Nkosi’s case falls under Schedule 5 of the Criminal Procedure Act, which requires the accused to demonstrate that granting bail would be in the interest of justice.

According to the magistrate, Nkosi did not meet this burden. Theledi emphasised that the evidence presented by the state established a strong prima facie case, increasing the likelihood of a successful prosecution.

Firearms, Dockets and Ammunition Found During Raid

During a raid at Nkosi’s residence, authorities discovered case dockets linked to serious crimes such as cash-in-transit heists and hijackings. SAPS firearms and ammunition were also recovered.

Nkosi argued that he had not been given enough time to return the weapons and ammunition following his suspension. However, the court was not persuaded by this explanation.

He will remain behind bars until 21 May as investigations continue.
