David Mabuza’s Daughter Takes Widow To Court Over R44.7m Pension Fund Dispute

The late Deputy President David Mabuza’s daughter, Tamara Silinda, has launched an urgent application in the High Court in Mpumalanga. She is seeking to stop the release of his R44.7 million pension fund to his widow, Nonhlanhla Mnisi.

Silinda, who is currently a first-year medical student at the University of Cape Town, argues that she is entitled to a share of the funds to cover her education and living expenses.

Claim of Unfair Distribution Among David Mabuza’s Dependents

In her application, Silinda insists that the pension fund should not be allocated solely to Mnisi. She maintains that distributing the money to only one person would be unjust, as several individuals were financially dependent on Mabuza.

Silinda is Mabuza’s daughter from his previous marriage, and her legal team is pushing for recognition of her dependent status in the pension distribution.

Legal Expert Weighs in on Pension Fund Act

According to legal analyst Clarisa Vermaakz, the law is clear on how pension funds should be distributed in such cases.

“Section 37 C of the pension funds act is there to ensure that when a member of a retirement fund dies before reaching the retirement age, the death benefit is directed to the people who are financially dependent on the member at the time of death.

“So, it creates a difference and a distinction between the dependents and nominees even by virtue of his will.

“Dependents in this case are given preference when it comes to the payout of his pension fund. And if the trustees consider the matter properly, she will most definitely be considered a dependent,” Vermaakz explained.
