Court Rejects Thabo Bester’s Bid for Laptop And Easier Prison Conditions

Convicted murderer and rapist Thabo Bester has suffered another legal blow after the Free State High Court rejected his application alleging that his right to a fair trial was being infringed.
Bester approached the court seeking permission to use a laptop while in custody. He also challenged his conditions of detention, arguing that being held in solitary confinement for 23 hours a day was unconstitutional.
Thabo Bester Raises Concerns Over Prison Conditions
Through his lawyers, Bester told the court that officials at the Department of Correctional Services had limited his access to adequate legal consultations.
His legal representatives argued that meeting their client at the Kgosi Mampuru Correctional Centre had become increasingly difficult.

Among the key issues raised were:
- Limited Privacy: Claims that consultations lacked sufficient confidentiality, allegedly weakening his defence.
- Time Constraints: Arguments that restricted daily access to his legal team compromised his right to prepare for trial.
- Restricted Movement: Objections to being transported to court in hand and leg restraints, which Bester contends is unlawful.
- Solitary Confinement: Assertions that 23-hour daily confinement prevents proper trial preparation and violates constitutional rights.
Judge Daffue Rejects Application
Despite the arguments presented, the High Court was not persuaded.
In his ruling, Judge Petrus Daffue acknowledged Bester’s circumstances but concluded that the applicant had not established a reasonable basis for the relief he sought.
The dismissal marks yet another setback for Bester as legal proceedings against him continue.
