Court Rejects Senzo Meyiwa Murder Accused’s Bid For Acquittal

The Pretoria High Court has dismissed an application for acquittal brought by Mthokoziseni Maphisa, one of the five men accused of murdering former Bafana Bafana captain Senzo Meyiwa in 2014.

Maphisa’s legal team had applied in August, arguing that the State failed to present sufficient evidence linking him to the crime. They contended that no reasonable court could convict him based on the testimony and material submitted.

Judge Rules Evidence Against Accused Must Be Answered

Delivering judgment on Tuesday, Judge Ratha Mokgoatlheng spent nearly two hours detailing the State’s case against Maphisa before ruling that he had a case to answer.

“I find there is prima facie evidence that needs answers; therefore, I cannot discharge accused #4,” Mokgoatlheng said.

The court highlighted the photographic and cellphone data presented by the prosecution as part of the evidence against Maphisa.

With the application denied, Maphisa will now have to mount a defence alongside his four co-accused, who were arrested in 2020 in connection with Meyiwa’s murder.
