Cop’s Testimony In Senzo Meyiwa Trial Raises Questions About Warrant Of Arrest On Kelly Khumalo

In the ongoing trial of the murder of former Bafana Bafana captain Senzo Meyiwa, an investigating officer, Sergeant Batho Mogola, revealed that she was aware of a draft regarding the warrant of arrest on Kelly Khumalo.

However, she admitted that she did not know why it was not authorised. Mogola’s testimony came during her cross-examination in the North Gauteng High Court in Pretoria.

During the cross-examination, Advocate Zandile Mshololo, representing accused five, Fisokuhle Ntuli, asked Mogola if she remembered the evidence regarding the warrant of arrest issued against Kelly Khumalo.

Mogola replied that she did not recall that part of the evidence. Mshololo then clarified that there was evidence of a draft application for the warrant of arrest in Docket 636.

State prosecutor Advocate George Baloyi interjected, stating that “issued” was not the correct word to be used, as the lead investigator, Brigadier Bongani Gininda, had mentioned a draft application.

Judge Ratha Mokgoatlheng confirmed this, adding that the draft was in the docket. Mogola acknowledged that she was aware of the draft application, as she had been briefed by Gininda. However, when asked why the draft was not authorised, Mogola stated that she did not know.

In October 2020, on the day the five Meyiwa murder accused appeared in court, the National Prosecuting Authority (NPA) mistakenly sent an internal memo to a media group, which implicated Kelly Khumalo in the Meyiwa murder trial.

The memo, later deleted with an apology issued, revealed instructions from Gininda to other officers regarding the investigation tasks.

The memo outlined at least 10 tasks related to the Meyiwa murder investigation, two of which concerned Kelly Khumalo.

Gininda requested statements or affidavits relating to confessions obtained from two individuals, accused one Muzikawukhulelwe Sibiya and accused two Bongani Sandiso Ntanzi.

The memo also requested cell phone communication records between the accused before, during, and after the commission of the crime, as well as cell tower locations and automatic vehicle locations of a VW Polo believed to have been used as the escape car in the Meyiwa murder in Vosloorus.

Regarding Kelly Khumalo, the memo requested her cell phone records and more information about a loan she may have taken around the time of the murder.

Advocate Thulani Mngomezulu, representing Sibiya, expressed his intention to subpoena Khumalo to testify in court. Additionally, Mngomezulu requested the subpoenas of Orlando Pirates boss Irvin Khoza and legendary music producer Chicco Twala to appear in court.
