Brown Mogotsi Denied Bail As Court Finds He Failed To Prove Residential Address

Alleged political fixer and North West businessman Brown Mogotsi will remain behind bars after the Johannesburg Magistrates’ Court refused his bid for bail.
The ruling was handed down on Thursday after the court reserved judgment on Mogotsi’s bail application last week. The court found that he had not sufficiently proven his residential address and that there was a risk he could avoid standing trial.
Mogotsi is facing charges of perjury, defeating the ends of justice, unlawful possession of a firearm and ammunition, as well as discharging a firearm in a public place. The charges relate to allegations that he orchestrated a fake assassination attempt in Vosloorus in November 2025.
Brown Mogotsi Bail Application Rejected Over Address Concerns
The State opposed Brown Mogotsi’s release, arguing that investigators encountered difficulties when attempting to verify his place of residence.
According to prosecutors, police were provided with multiple addresses in the North West but were unable to confirm that Mogotsi lived at those locations. The State also claimed he delayed submitting a statement and failed to disclose information that could have assisted investigators in tracing him.
In handing down judgment, the presiding officer pointed to inconsistencies in the addresses submitted to the court.
“There are three different addresses provided by the applicant.”

The magistrate further stated: “The applicant failed to prove before this court that he has a proper address.”
The court concluded that the uncertainty surrounding Mogotsi’s residence could make it difficult for authorities to monitor him should he be released.
“Therefore the court found out that there is no proper address for the applicant and it will be difficult for the State to trace him and there may be a likelihood that he will evade his trial.”
Brown Mogotsi Faces Allegations Of Staged Assassination Attempt
Prosecutors alleged that eyewitnesses observed Mogotsi leaving his vehicle and firing shots before later reporting that there had been an attempt on his life.
The State further argued that surveillance footage showed no other vehicles in the vicinity at the time of the incident and suggested that Mogotsi was alone in the vehicle.
Advocate Thami Mpekana also alleged that Mogotsi attempted to bribe a police officer during matters relating to his bail application. Investigators further accused him of supplying incorrect address information and misleading authorities about his whereabouts.
The State additionally referred to a previous investigation dating back to 2007, claiming that incorrect address details had also been provided during that matter.
Brown Mogotsi Defence Challenges State’s Claims
Mogotsi’s legal representative, advocate Nthabiseng Mohamane, disputed the allegations raised by the prosecution during the bail proceedings.
She argued that sufficient proof had been submitted to establish her client’s residence, including an affidavit from his customary wife, telephone records, GPS location data, WhatsApp communications and contact information.
Mohamane also rejected claims that a lease agreement contained problematic discrepancies. She maintained that the lease commenced on 1 July 2024 and expires on 1 July 2027, and that any conflicting date on the document was simply a typographical error.

The defence further relied on municipal and traditional council records, as well as personal belongings found at the property, to support Mogotsi’s claim that he resides there.
In addition, Mohamane argued that the offences before the court were not serious enough to justify denying bail and maintained that Mogotsi was not a flight risk. She pointed to his previous cooperation with proceedings before the Madlanga Commission and Parliament’s ad hoc committee.
Despite these submissions, the court found that the interests of justice did not favour his release.
“Therefore, the interest of justice does not permit his release. As there is no proper address, the bail denied,” the court ruled.
The matter has been postponed to 12 June, when Mogotsi’s legal team is expected to obtain a copy of the docket. He remains in custody.
