Brown Mogotsi Bail Denied Again As Court Questions His Addresses

Self-proclaimed political fixer Brown Mogotsi will remain behind bars after his latest bid for freedom was rejected by the Johannesburg Magistrates’ Court on Tuesday, 22 September.

The court found that Mogotsi had provided five different addresses during his various bail applications, raising concerns about whether he could be trusted to provide accurate information about where he would reside if released.

Magistrate Anneline Tlhapi ruled that Mogotsi’s latest application did not present new facts that could change the court’s previous finding that he posed a flight risk.

Brown Mogotsi’s Five Addresses Raise Court Concerns

The court’s decision centred heavily on the addresses Mogotsi had provided during his bail applications.

According to the ruling, three of the five addresses were not correct, while another was an address where Mogotsi had never lived. A further address had already been available to him during his initial bail application, meaning it did not qualify as a new fact capable of changing the earlier decision.

Magistrate Tlhapi said Mogotsi had failed from the outset to provide a residential address that could be reliably and independently verified.

“The court found that the applicant cannot be trusted, and he failed from the beginning to be a trustworthy applicant who can provide a reliable and provable residential address.”

Court Rejects Mogotsi’s Latest Bail Bid

Mogotsi's latest application was brought on the basis of alleged new facts, including information relating to residential addresses. The State opposed his release and argued that the information presented did not sufficiently address the concerns raised during previous bail proceedings.

The NPA had previously confirmed that Mogotsi was seeking bail based on new facts, with the matter postponed to 22 September for judgment. He has remained in custody since his arrest in May.

The court ultimately found that the latest application did not alter its previous assessment of Mogotsi as a flight risk.

“Therefore, it is not in the interest of justice that he be released on bail. Bail is denied.”

Mogotsi Faces Charges Over Alleged Staged Shooting

Mogotsi faces several charges arising from an alleged shooting incident in Vosloorus on 3 November 2025.

According to the NPA, he allegedly reported to police that he had been driving alone when occupants of a bakkie pursued him and fired multiple shots at his vehicle, forcing him to stop and flee on foot. Prosecutors allege that the incident was staged and that Mogotsi himself fired at his vehicle.

The charges include unlawful possession of a firearm and ammunition, discharging a firearm in a built-up area, defeating or obstructing the administration of justice and perjury. Mogotsi has disputed the State’s version of events and previously challenged evidence presented against him, including CCTV footage.

With his latest bail application dismissed, Mogotsi will remain in custody as the criminal case continues.
