Bafana Sindane’s Bid To Stop Madlanga Subpoena Struck Off The Roll

Taxi boss Bafana Sindane has suffered another setback in his attempt to challenge a subpoena issued by the Madlanga Commission. The Bafana Sindane court application was struck from the Gauteng High Court in Pretoria’s roll after the required papers were not before the court. The ruling adds to the legal challenges facing Sindane as the commission prepares to resume its public hearings.

The Bafana Sindane court matter was dealt with briefly by Judge Nomonde Mngqibisa-Thusi, who said the necessary documents had not been filed for the case.

The judge therefore removed the application from the roll without considering the substantive arguments. The ruling represents another unsuccessful attempt by Sindane to stop proceedings connected to his appearance before the commission.

“There were no papers for this case, so the matter is struck off the roll.”

Sindane is expected to appear before the Madlanga Commission in connection with a series of text messages exchanged with his associate, Joe “Ferrari” Sibanyoni. Those messages have been linked to allegations concerning an alleged extortion operation. They were entered into the commission’s record last week after an earlier interdict application by Sindane failed.

Bafana Sindane Linked To Extortion Allegations At Commission

The Bafana Sindane allegations centre on claims involving an alleged violent criminal protection racket, leaked state intelligence and the arranging of hitmen. Sindane and Sibanyoni have also been accused of allegedly extorting more than R2 million from Mpumalanga contractor Tengane Mining. The pair are further accused of allegedly forcing businesses operating along the Moloto Road transport route to pay protection fees.

The text messages have also raised questions over payments reportedly made towards the legal costs of two convicted taxi-murder hitmen. The pair allegedly helped fund R250,000 in legal fees for Gwabo Mahlangu and Tshegofatso Richmond Makofane through a lawyer. The allegations remain before the commission.

Sindane previously sought to prevent the messages from being made public, but that application was dismissed with costs. The messages were subsequently read into the commission’s proceedings. Sindane has not yet given his response to the allegations.

Bafana Sindane Response Awaited As Madlanga Hearings Resume

The Bafana Sindane response is now among the key outstanding issues facing the commission when its public hearings resume on 9 November. His testimony could provide his account of the allegations and the contents of the messages placed before the inquiry. Until then, the evidence already presented continues to form part of the commission record.

The latest court setback means Sindane’s effort to stop the subpoena has not succeeded in its current form. The commission is expected to continue examining the allegations and evidence involving Sindane and Sibanyoni when proceedings resume. Sindane remains yet to respond publicly before the inquiry to the claims made against him.
