Bafana Mahungela Storms Out Of Court After Bail Bid Rejected

A furious Bafana Mahungela stormed out of the Alexandra Magistrate’s Court on Thursday, muttering expletives after the magistrate dismissed his latest bid for bail.

The 21-year-old’s legal team had sought to introduce what they claimed were new facts in an effort to secure his release. However, the magistrate sided with the State, ruling that the court lacked jurisdiction to hear the application because the matter had already been transferred to the Gauteng High Court, Johannesburg.

“This court does not have jurisdiction over this application, and therefore, this matter is dismissed,” the magistrate said.

Mahungela is accused of the brutal murder of Delta Park High School teacher Kirsten Kluyts, who was attacked while jogging in Parkmore, Sandton, in November 2023. He faces charges of kidnapping, robbery with aggravating circumstances, murder, and attempted rape, all of which he denies.

Legal Tug-of-War

Mahungela’s defence, led by Advocate Stanley Jacobs, argued that the Alexandra court—being the court of first instance—remains compelled to hear the new facts despite the case being transferred to the high court. Jacobs accused the magistrate of “defying” a previous high court directive by refusing to entertain the application.

“The High Court referred us back to this court. Essentially, the magistrate is defying the High Court because we cannot bring this application there,” Jacobs told the media outside the courthouse.

The State countered that the matter now squarely falls under the jurisdiction of the high court, citing case law to support its objection.

Bafana Mahungela Trial Ahead

Mahungela was arrested on November 26, 2023, after CCTV footage allegedly linked him to the scene. His trial is scheduled to begin in the Johannesburg High Court on October 13, 2025, following a pre-trial conference in August.

Earlier this year, the defence revealed the existence of DNA results dated December 22, 2023, which they claim do not link Mahungela to the crime scene—a key point they hoped to raise as part of their new bail application.

Despite this latest setback, Mahungela’s legal team has indicated they will continue to challenge the State’s case as the trial date approaches.
