Alleged Rapist Freed Over Victim’s Suicide

A heart-wrenching case has sparked outrage after three men accused of gang-raping a 14-year-old girl were released from prison due to a technicality.

The Bloemfontein High Court in its ruling freed the perpetrators noting, the trial was rendered unfair because the complainant died before the defense lawyers could complete their cross-examination.

The teenager had testified against her alleged attackers who were later freed, to be well-known to her, having attended school together.

According to her evidence-in-chief, one of the accused grabbed her and forcefully took her to his cousin’s house, where she was gang-raped by all three.

Despite her traumatic experience, the trial which later freed the perpetrators was repeatedly postponed, causing further distress to the victim.

Cross-Examination And Tragic Outcome

During cross-examination, the complainant appeared uncomfortable and eventually left the room without explanation.

Before further cross-examination could occur, she tragically took her own life.

Judge Johannes Daffue ruled that the court could not speculate on what might have happened had the cross-examination been completed and that fairness dictated the complainant’s evidence be ignored in total.
