3 Sentenced For Illegal Abalone Possession In Graaff Reinet Case

Three (3) men have been sentenced in the Graaff Reinet Regional Court for their involvement in illegal abalone possession, control, and transportation.

Frank Barends (53), Mannetjie Neels Chaka (50), and Brandon Herriot Lamont (48) were convicted after a thorough investigation by authorities revealed their illegal activities involving over 9,300 units of abalone, worth over R1 million.

Court Sentences For Illegal Abalone Activities

On Monday, 17 March 2025, the Graaff Reinet Regional Court accepted a plea agreement where the accused acknowledged their role in transporting illicit abalone on 2 May 2023.

The three were traveling on the R75 in two vehicles – a blue Toyota Camry and a gold Porsche – when they were intercepted by police.

A search of the vehicles uncovered 9,398 units of abalone valued at R1,057,360.

Each of the three accused received the following sentences:

1. Frank Barends: A fine of R150,000 or 24 months imprisonment, with R50,000 or 8 months suspended for five years, conditioned on no similar convictions during the suspension. He also received a 12-month sentence or R2,000 fine for a fraud charge.
2. Mannetjie Chaka: A fine of R75,000 or 18 months imprisonment, with R25,000 or 10 months suspended for five years, conditioned on no similar convictions.
3. Brandon Lamont: A fine of R100,000 or 24 months imprisonment, with R50,000 or 12 months suspended for five years, conditioned on no similar convictions.

Additionally, all three were declared unfit to possess firearms under the Firearms Control Act 60 of 2000.

The Porsche involved in the illegal operation was also forfeited to the State.

Nathan Zealand Released On Bail In Separate Abalone Case

In a separate but related case, Nathan Zealand (34) appeared in the Graaff Reinet Magistrate’s Court on Tuesday, 11 March 2025, facing charges of illegal abalone possession, control, and transportation.

Zealand was arrested on 10 March 2025 near Jansenville, where police discovered 12,380 units of abalone worth approximately R4,204,436 in his possession while he was traveling in a white Toyota Hilux.

Zealand was granted bail of R5,000, and the case has been postponed to 9 May 2025 for further investigation. His vehicle was also seized as part of the ongoing probe into the illegal abalone trade.

The sentencing of Barends, Chaka, and Lamont, according to the authorities serves as a deterrent for the serious legal consequences involved in the illegal trafficking of marine resources.
