The battle between Public Protector (PP) Busisiwe Mkhwebane and Minister Pravin Gordhan rolls around judiciary. PP wants Gordhan to be imprisoned for accusing her as a stunning incompetence. This centred around SARS saga.

Mkhwebane wants Minister Gordhan to face jail time for, accusing her of “stunning incompetence”, suggesting she may be embroiled in State Capture and saying she was unfit to hold office.

This is in his case to overturn her report on SARS officials Ivan Pillay’s early retirement.

According to the Office of PP, the minister claimed in court papers that the Public Protector Mkhwebane was part of state capture and corruption.

The office added Gordhan claimed that her report was released for political reasons to prevent the minister from appointment to cabinet.

Embattling PP was accused by number of people who suggested that she is not fit to hold the office. However, the EFF supported her against Gordhan and Ramaphosa, in defence of the Institution rather than the office holder.

The Parliament has nominated panel to adjudicate the fitness of PP to hold the office, unfortunately with the COVID-19 the process was held pending commencement.

PP office state: “Contempt of the Public Protector is similar to contempt of court. To fully appreciate the seriousness of the minister’s conduct in this regard, one must imagine a situation where a minister accuses a sitting judge of corruption and being motivated by politics.”
