National Emergency declaration by president Donald Trump is receiving great protest as sixteen States have jointly filed a lawsuit against, arguing that the president doesn’t have a constitutional right to declare national emergency.

The Washington Post report shows that the lawsuit was filed in U.S. District Court for the Northern District of California.

These are the states that are involved in the suit New York, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Minnesota, Nevada, New Jersey, New Mexico, Oregon, Virginia and Michigan, more may join.

Trump decided to declare national emergency as he has long threatened after failing to get congressional endorsement for $5.7 billion in continuing the funding of the US-Mexico wall, and signing a bill of $1.375 billion for border security.

President Trump declaration of national emergency last week was to enable him go around the legislative branch to obtain the billions so he could start work at the US – Mexico border.

The lawsuit says, “Contrary to the will of Congress, the President has used the pretext of a manufactured ‘crisis’ of unlawful immigration to declare a national emergency and redirect federal dollars appropriated for drug interdiction, military construction and law enforcement initiatives toward building a wall on the United States-Mexico border.”

The lawsuit also argued that the US president does declared the national emergency out of his own admission, which is not necessary.

While making the declaration of national emergency last week, President Donald Trump noted he didn’t need to declare a national emergency for him to build the border wall and enhance security at the border, but he is doing so to finish it much faster.

The sixteen states lawsuit was championed by a California Attorney General Xavier Becerra who also twitted on Monday that they are challenging Trump’s ”#FakeNationalEmergency,” which he described as a brazen overreach to rob taxpayers & an insult to the Democratic principles enshrined in our Constitution.
